In keeping with this tradition, CFF is dedicated to protecting and respecting your privacy and handling any personal information we obtain from you with care and respect. This Privacy Policy is designed to answer your questions regarding our privacy policies and principles.

Visiting Our Website

For each visitor to our website, our web server automatically recognizes only the IP address of your computer. When you visit the CFF Website to manage your MyiClub account, subscribe to fitness program/class schedules, and or sign-up for our Newsletter you may choose to give us basic information: name, email address, mailing address, ZIP code, phone, and credit card numbers. This allows us to process your transactions more efficiently, and ultimately, to give you a higher caliber of customer service. When you visit our website, we may collect more information: your Internet service provider's address, the name of the Web page directing you, as well as your clicks and activity on our site. This tracking data helps us understand how to make our site more available and user friendly to our customers.

The personal information we collect is above all intended to offer better customer service and to improve communications. The customer information you provide can help CFF provide greater security and inform you of products and services that may be of interest.


Secure Information Under Lock And Key

CFF is proud to be a certified PCI DSS Compliant Service Provider. The CFF website uses Secure Socket Layer (SSL) technology to encrypt personal information such as User IDs, Passwords, and account information over the Internet. Any information provided to you is scrambled en route and decoded once it reaches your browser. We take the following steps to protect our customers' personal information against loss, misuse, and alteration.

You May Remove Your Name From Our Lists At Any Time

To delete your name from the CFF email mailing list, simply contact us by email at info[@]calfamfit.com or by selecting the “unsubscribe” link at the bottom of any CFF email. Be sure to provide your full name, mailing address, email address, and phone number. We appreciate your patience as it may take up to six to eight weeks to process your request from the date of receipt.


Children's Privacy Statement

CFF adheres to a strict privacy code regarding children and does not knowingly accept personal information from any child. If it is brought to our attention that a subscriber is under age, we will immediately remove all personal and identifiable information from our records in compliance with the Online Children's Privacy Protection Act of 1998. In addition, we will not disclose this information to any other companies.

This children's privacy statement explains our practices with respect to the online collection and use of personal information from children under the age of thirteen, and provides important information regarding their rights under federal law with respect to such information.

    • CFF’s website is not directed to children under the age of thirteen and we do NOT knowingly collect personally identifiable information from children under the age of thirteen as part of our website. If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen as part of our site, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of thirteen.
    • We do NOT knowingly allow children under the age of thirteen to publicly post or otherwise distribute personally identifiable contact information through our website.
    • Because we do not collect any personally identifiable information from children under the age of thirteen as part of our website, we do NOT condition the participation of a child under thirteen in the website's online activities on providing personally identifiable information.

Employee Conduct

The CFF Privacy Guidelines express our absolute commitment to integrity, our related corporate values and ethical standards and the associated business conduct we expect from all our employees. The guidelines include very specific guidelines concerning the safeguarding of confidential information, which includes customer information. In general, these guidelines limit employee access to confidential information, and limit the use and disclosure of such information to specifically authorized processes and transactions. If it is determined that employees have violated the guidelines, corrective action may be taken, including immediate dismissal.


Security

CFF makes reasonable efforts to maintain the security of your personal information in order to prevent unauthorized access to it through the use of technology and internal procedures.

Partnerships

We currently contract with online partners to help manage and optimize our Internet business and communications. We use them to send emails that you have agreed to receive. Web cookies are used in those email messages and at our website to help us measure the effectiveness of those emails. You can "opt out" of these emails at any time by unsubscribing from CFF's email mailing list. We reserve the right to change email providers at any time.

Information Disclosed If Required By Law

If required by law, CFF may provide any and all information we have about you to law enforcement or other government agencies, pursuant to a subpoena, warrant, or other order by a court of competent jurisdiction. In all cases, we will require written documentation of the request, proof of the identity of the law enforcement official making the request, and we will take reasonable steps to authenticate the validity of the request. Any law enforcement or government agency request submitted with less than a court-issued order will be evaluated on a case-by-case basis according to the need and urgency, as well as the particular law enforcement agency making the request.


Privacy Policy Updates

Efforts to bring new services, ideas and partners to benefit our customers may make it necessary for us to create a new Privacy Policy. If this occurs, we will post the new policy on our website. Once posted, the new policy will go into effect immediately, replacing any previously stated policy.

CFF may also amend our current Privacy Policy at any time. If we amend this Privacy Policy to permit material changes in the way we collect, use, and/or share your personal information, we will notify you of such amendment by sending you an email at the last email address that you provided us, and/or by prominently posting notice of such amendment on the websites covered by this Privacy Policy. Any such amendment to this Privacy Policy will be effective thirty (30) calendar days following either our dispatch of an email notice to you or our posting of notice of the changes on the websites covered by this Privacy Policy.

Please note that, at all times, you are responsible for updating your personal information to provide us your current email address. In the event that the last email address that you have provided us is not valid, or for any other reason is not capable of delivering to you the notice described above, our dispatch of the email containing such notice will nonetheless constitute effective notice of the amendment described in the notice. In any event, an amendment to this Privacy Policy may permit material changes in the way we use and share personal information that you provided us prior to our notification to you of such amendment.

The effective date of this CFF Privacy Policy is July 1, 2013. It replaces all prior privacy policies issued by CFF. We reserve the right to change the CFF Privacy Policy at any time. Any changes to our Privacy Policy will be reflected in the updated version displayed at our corresponding website.

Consent to Receive Telemarketing Calls & Texts

By agreeing and checking the Terms and Condition’s box, I authorize CFF and ABC Financial Services to deliver to me, at the telephone, cellphone, or email address(es) provided, telemarketing calls, emails and texts and informational calls, emails and texts. I UNDERSTAND THAT I AM NOT REQUIRED TO AGREE TO BE CONTACTED AS A CONDITION OF PURCHASING ANY PROPERTY, GOODS OR SERVICES. Mobile App

This privacy policy governs your use of the software application: Igniteble Proximity Platform (“Application”) for mobile devices that was created by Ignite BLE, LLC. The Application is designed to provide meaningful information and a more personalized experience to you, based on your behavior, location and interaction with the Application. This privacy policy describes how we collect and use the information collected through the Application. The policy will provide the privacy options available to you for the use of your information.

What information does the Application obtain and how is it used?  

User Provided Information: The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please understand that you may not be able to use some of the features offered by the Application unless you register with us. When you register with us and use the Application, you generally provide (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you redeem offer, respond to any information, or download or use applications from us; (c) information you provide us when you contact us for help; (d) information you enter into our system when using the Application, such as contact information and location and facility use data. We may also use the information you provided us to contact you from time to time to provide you with important information, required notices and marketing promotions.   

Automatically Collected Information: In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Does the Application collect precise real time location information of the device?

When you visit the mobile application, we may use GPS technology, Bluetooth Low Energy beacon technology (or other similar technology) to determine your current location in order to determine the building and/or city you are located within and display relevant information based on this data. We reserve the right to share this location information with our partners. If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.

Do third parties see and/or have access to information obtained by the Application?

Yes. We will share your information with third parties only in the ways that are described in this privacy statement. We may disclose User Provided and Automatically Collected Information:

  • As required by law, such as to comply with a subpoena, or similar legal process;
  • When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • With our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.
  • With other services in order to improve the accuracy or variety of offerings to you.

Automatic Data Collection and Advertising

We may work with analytics companies to help us understand how the Application is being used, such as the frequency and duration of usage. We might work with advertisers and third party advertising networks or third party coupon providers, who need to know how you interact with information provided in the Application. These third parties may use some of the information collected by the Application, including, but not limited to, the unique identification ID of your mobile device and your mobile telephone number. To protect the anonymity of this information, we use an encryption technology to help ensure that these third parties can’t identify you personally. These third parties may also obtain anonymous information about other applications you’ve downloaded to your mobile device, your non-precise location information, longitude and latitude, (e.g., your zip code), and other non-precise location information in order to help analyze and serve anonymous targeted information on the Application. We may also share encrypted versions of information you have provided in order to enable our partners to append other available information about you for analysis. If you’d like to opt-out from third party use of this type of information to help serve targeted advertising, please visit the section entitled “Opt-out” below.

Promotions & Surveys

In connection with promotions, surveys, or other projects, we may ask you whether you object to our specified data use or sharing. If you opt-out under such circumstances, we will respect your decision.

What are my opt-out rights?

There are multiple opt-out options for users of this Application: Opt-out of all information collection by uninstalling the Application: You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at DNC@calfamfit.com

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at DNC@calfamfit.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children’s Privacy

We do not use the Application to knowingly collect any personal information, solicit data from or market to children under the age of 18. If you, a parent or guardian (parental consent) becomes aware that his or her child has provided us with information without your consent, he or she should contact us at DNC@calfamfit.com. If you become aware that a child under thirteen (13) has provided us with personal information without parental consent, we will take steps to delete such information from our files, within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or text message. By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
