Official Rules and Regulations

The following rules and regulations (the “Official Rules”) govern the California Family Fitness “Win the Week Challenge” Sweepstakes (the “Sweepstakes”) sponsored by California Family Fitness (“Sponsor”). VOID WHERE PROHIBITED BY LAW; ELIGIBILITY RESTRICTIONS APPLY.

FORM OF ENTRY: 
1. You may enter the sweepstakes by participating in the California Family Fitness Win the Week Challenge from November 4, 2019-December 22, 2019.   To be eligible, participant must be a member (or registered guest) in good standing of CALIFORNIA FAMILY FITINESS Clubs during the above challenge period.
2.  Overall Win the Week Challenge winner is determined based upon the number of eligible gym check-ins (not to exceed one (1) gym check-in per day) and group fitness class check-ins (unlimited) during the Win the Week Challenge from November 4, 2019-December 22, 2019.

By entering this I authorize CFF and ABC Financial Services to deliver to me, at the telephone, cellphone, or email address(es) provided, telemarketing calls, emails and texts and informational calls, emails and texts. I UNDERSTAND THAT I AM NOT REQUIRED TO AGREE TO BE CONTACTED AS A CONDITION OF PURCHASING ANY PROPERTY, GOODS OR SERVICES. PROMOTION PERIOD; DEADLINE FOR SUBMISSION OF ENTRIES: The Sweepstakes runs from Monday, November 4, 2019 through Saunday, December 22, 2019 (the "Promotion Period"). 

ELIGIBILITY; PERSONAL INFORMATION: Open only to legal U.S. residents who, as of Friday, November 4, 2019, are at least 18 years of age and members or registered guests in good standing of California Family Fitness. Employees, officers and representatives of Sponsor as well as the immediate family (spouse, parents, siblings and children) and household members of each such person, are not eligible. No mechanically reproduced entries will be accepted. Personal information will be used in accordance with the Privacy Policy at http://www.californiafamilyfitness.com/cff-privacy-policy Sponsor may utilize each entrant’s personal information based on which opt-in(s) the entrant has selected to receive future email or text messages. All entries become the property of Sponsor. Entries will be deemed as made by the authorized account holder of the telephone number or email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address or telephone number by an Internet access provider, online service provider, mobile service provider or other organization that is responsible for assigning email addresses, domains, or phone numbers associated with the submitted information.

DETERMINATION OF OVERALL WINNER: One (1) winner per category will be selected by Sponsor or its agent from all eligible entries received within the Promotion Period. Eligible entries are registered participants in the Win the Week Challenge  and that otherwise meet the requirements described in these Official Rules. Overall prize winner will be determined by calculating the number of gym check-ins (up to 1 per day) and classes attended during the Win the Week Challenge from November 4, 2019-December 22, 2019.  The winner(s) will be the person(s) with the highest number of club and class check-ins. Accounting of the prize winners will be held on or about December 27, 2019.  All accounting is final and binding on all matters related to the Sweepstakes. The winner does not need to be present at the accounting, and will be notified by e‑mail within 48 business hours of his or her points being determined as the highest. (“Notification”). Upon Notification, the winner must claim his or her prize by e-mail or to Sponsor’s telephone number provided within 48 hours of notification.  

PRIZE: There is one (1) sweepstakes prize:

• One (1) year free Cal Fit membership dues (ARV up to $69.99 monthly ($839.88 for the year), or current retail value)

Total actual retail value (“ARV”) for the prize is listed above.  Any tax on any prize and all expenses not expressly specified herein are the sole responsibility of the respective prize winner.  Winners of prizes valuing $600 or more must provide a signed, legible copy of an IRS form W-9 for tax purposes per IRS law. Prize is non-transferable. The difference between any stated value and the actual value of a prize will not be awarded to the winner. No prize substitutions shall be permitted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value should any featured prize become unavailable. 

LIMITATIONS OF LIABILITY; RELEASE AND INDEMNIFICATION:

Sponsor is not responsible for any: (a) telephone, computer system, hardware, software, network or other technical failure, malfunction or error; (b) communication disruption or delays, including those related to or caused by Internet traffic, virus, bug, non-authorized intervention or human error; or (c) damage caused by computer virus or bug, resulting in damage to any computer or cell phone from an entrant’s access or the Sweepstakes website. Sponsor is not responsible for printing or typographical errors in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible entries; or for transactions that are lost, misdirected, or fail to enter into the processing system, or that are processed, reported or transmitted late or incorrectly, or that are lost for any reason, including, without limitation, computer, telephone, paper transfer, or human error; or for electronic, computer, or telephonic malfunction or error. Each winner acknowledges that Sponsor has neither made any, nor is in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. By participating in the Sweepstakes, each entrant agrees to indemnify and hold harmless Sponsor, and all sponsors and administrators of the Sweepstakes, along with their respective parent entities and subsidiaries, affiliates, successors, assigns, directors, officers, members, managers, employees, attorneys and agents) from and against any and all injuries, losses, damages, claims and actions of any kind arising from or relating to participation in the Sweepstakes, or acceptance, possession, use, misuse or non-use of any prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages. By accepting a prize, each winner further releases Sponsor, its parent entities, directors, officers, members, managers, employees, attorneys and agents  from any and all claims, liability, loss or damage arising out of or in connection with the awarding, receipt, possession and/or use or misuse of any prize or participation in any prize-related activity.

RIGHT TO CANCEL OR SUSPEND SWEEPSTAKES; DISQUALIFICATION: 

Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes without advance notice should virus, bugs, technical malfunctions or other causes beyond Sponsor’s control corrupt the administration, security or proper play of the Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption or damage, will be disqualified.

RIGHT TO USE NAME, PHOTO AND LIKENESS:

By accepting a prize, each winner consents to the use of his/her name, photo and/or likeness in any and all media by Sponsor for advertising and promotional purposes without additional compensation, except where prohibited.

Each person who participates in the Sweepstakes fully and unconditionally agrees to comply with and abide by these Official Rules and the decision of Sponsor, which shall be final and binding in all respects.
